You must be at least 18 years old to create an xflag account and agree to these terms. Children may use xflag through a profile within an adult’s account. If you set up a profile for a child, you confirm that you are their parent or legal guardian, that you consent to our collection of the limited information described in our Privacy Policy, and that you are responsible for how they use the service.
Sign-in is handled by our identity provider using Google or an emailed one-time link. Keep access to your email account secure, since anyone who controls it can sign in as you. Tell us promptly at hello@xflag.ai if you think someone else has used your account. One account is for one household; please do not share it more widely.
While xflag is in beta we make no promise about availability, uptime, or that data you create will be preserved. We may add, change, suspend or remove any part of the service at any time, and we may need to delete or reset data. We will try to give notice of significant changes, but we may not always be able to.
xflag is free during the beta. We may introduce paid plans in the future. If we do, we will tell you in advance, and access you already hold at that time will not be taken away from you retroactively. We will never charge you without asking you first.

xflag and its games, code, artwork and content belong to us or our licensors. You get a personal, non-exclusive, non-transferable licence to use them for your household’s own non-commercial enjoyment, which ends if your account is closed. Anything you create inside a game stays yours.
We rely on third parties, including Clerk for sign-in and Cloudflare for hosting. Their own terms and privacy policies apply to the parts they operate.
Some xflag games teach programming and other subjects. They are provided for general educational and entertainment purposes. We do not promise any particular learning outcome, and xflag is not a substitute for formal instruction or supervision.
TO THE FULLEST EXTENT PERMITTED BY LAW, XFLAG IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
Nothing in these terms excludes or limits any right you have that cannot lawfully be excluded, including consumer rights in your country.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) [[US$100]].
You may close your account at any time by emailing hello@xflag.ai. We may suspend or close an account that breaches these terms, or if we stop offering the service. Sections 6, 9, 10 and 12 survive the end of these terms.
These terms are governed by the laws of [[STATE / COUNTRY]], without regard to conflict of laws rules, and the courts of [[VENUE]] will have jurisdiction. [[CONFIRM WITH COUNSEL — and note that consumer protection law in the user’s own country may apply regardless.]]
We may update these terms. We will update the version above and, for material changes, notify the account holder by email before they take effect. Continuing to use xflag after that means you accept the updated terms.
